CLASS ACTION SETTLEMENT INFORMATION

Welcome to the Information Website for the Class Action Settlement in John Garland v. Memphis-Shelby County Airport Authority, Case No. 09-2479 (W.D. Tenn.). This website describes the case and the settlement between John Garland ("Plaintiff") and the Memphis-Shelby County Airport Authority (the "Airport"). We have tried to design this website to help you obtain information about the proposed settlement of this case. • If you used a credit or debit card to pay for parking at the Memphis International Airport between June 4, 2008 and June 4, 2009, then you may be a class member and be entitled to parking vouchers for use at the Memphis International Airport.
• The proposed settlement resolves a lawsuit over whether the Airport violated certain requirements imposed by the Fair and Accurate Credit Transactions Act ("FACTA"). The Airport denies liability, but has agreed to the proposed settlement because it avoids costs and risks from continuing the lawsuit. The settlement entitles class members to compensation in the form of parking vouchers and releases the Airport from further liability.
• Under the terms of the settlement, the Airport will make available vouchers good for a discount on parking fees at the Airport. Vouchers will have a value of $5.00 each. Claimants submitting a claim form demonstrating that they received one debit/credit card receipt will receive three vouchers for a total value of $15.00. Claimants submitting a claim form demonstrating that they received more than one debit/credit card receipt will receive six vouchers for a total value of $30.00. The vouchers will expire no earlier than one year after the end of the claim period, and may be obtained by submitting a claim form. The guaranteed minimum value of the settlement fund will be $1,005,000. If the claimed vouchers do not exhaust the guaranteed minimum value, then the Airport will reduce the daily parking rate by $2.00 per transaction to all persons parking in the "economy" parking garage, also known as the new constructed Ground Transportation Center, at the Airport, until such time as the guaranteed minimum amount has been paid in full. Garland will receive a class representative incentive payment of $2,500.00, separate and apart from the Settlement Fund. Class Counsel will receive not more than $275,000.00 in payment of attorney's fees and expenses out of the Settlement Fund.

NOTICE

The period of time for filing a Claim has expired. Pursuant to the Settlement Agreement and Final Order of the U.S. District Court for the Western Division of Tennessee, Claims must be postmarked by February 14, 2012 in order to participate in the Settlement and qualify for parking vouchers.
